In a divorce, if the man is aginst it and the women divorces him, does he still have to split the cash?

Well, i was just wondering because my dad is divorcing my step mom, and, he owns a buisness, i was just wondering because he was planning on passing that buisness onto me when he is older and retires and she might take 50% of it.In a divorce, if the man is aginst it and the women divorces him, does he still have to split the cash?
They will have to split some things but his business should not be involved if he had it before marrying her. The courts will also consider how long they were married.In a divorce, if the man is aginst it and the women divorces him, does he still have to split the cash?
It depends what state they live in. If they're in a community property state then all assets are split 50/50 during a divorce unless a pre-nuptual agreement has been created.


If they aren't in a community property state and they can't agree on who gets what, then the court gets involved and splits things fairly between the two of them. Then whatever is ordered is what they have to follow...its best to split things before the divorce.
The marital assets will be divided equally. If his business is subject to the marital property act it will be divided equally.





PS. IT's not your business. This is between your dad and step-mom.
They BOTH must abide by the terms of the divorce decree, whether one wants the divorce or not...in the end what the JUDGE says, GOES.
If your step mom doesn't work, then yes. Also, if they have children, then definitely.
i think it depends what state you are in but yes there is a big chance she gets half.
she can get half if he didn't make her since a prenup
